We at OK Capsule Inc. ("OK Capsule," "Capsule," "we," "us," or "our") provide this privacy policy ("Privacy Policy") to help inform you about how we collect information, how we use the information, and with whom we disclose such information. This Privacy Policy relates to our online services (the "Services"), which are available to you through a variety of platforms, including our website www.okcapsule.com (the "Website"), partner portal, APIs, mobile application, and other interactions by telephone, email, chat, or other media (collectively, the "Platform").

OK Capsule is a business-to-business platform. Our tech Platform allows us to provide B2B custom, private-labeled supplements to end-use customers on behalf of the brands, practitioners, and platforms we serve (our "Partners"). When a Partner provides us with its customers' information (such as name, shipping address, email address, and supplement selections) so that we can manufacture, pack, and ship an order, we process that information solely on the Partner's behalf and under our agreement with that Partner. We do not sell such information, share it for advertising, or use it for our own marketing. If you are an end-use customer of one of our Partners, the Partner you purchased from is responsible for your personal information, and you should direct privacy requests to that Partner; we support our Partners in honoring such requests, including requests for deletion.

1. The Information We Collect

1.1. Information You Provide to Us

We collect information you provide to us. For example, we collect information when you sign up, log in, use the client portal, email us, call us, or place an order. Such information may include your name, email address, date of birth, mailing address, phone number, company name and role, and other information. Such information collected may include personally identifiable information, personal data, or personal information.

Additionally, when you log in or use our client portal for access to our Platform or for account management, you may voluntarily provide additional information about yourself such as your nutritional or supplement interests, health and wellness, including short-term and long-term health goals, lifestyle, views about health/wellness, gender, and other demographic information. You may also voluntarily provide us with information about your health and diet, vitamin supplements ordered, herbal and nutraceutical needs, or product, service, and delivery preferences. We do not use health or wellness information for advertising purposes.

1.2. Information We Collect Automatically

We automatically collect information about you when you access or use the Platform or place an order. Such information may include your IP address, browser type and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of the Website you visit, order information, device identifier, and other similar information concerning your use of the Services and Platform. Our Platform also records first-party telemetry tied to activity in our pack-builder tools (for example, session identifier, referrer, domain, and actions such as adding an item to a pack) to operate and improve the Services.

We may use cookies or similar technologies to help us collect information and to enhance your experience using the Services. Cookies are small packets of data that a website stores on your browser so that your computer will "remember" information about your visit. We use both session and persistent tracking technologies. If you do not want the Platform to place a cookie on your hard drive or mobile device, you may be able to turn that feature off — however, the Services may not function properly.

The table below lists the cookies and similar technologies from third parties in use on our Website, what information is involved, and the purposes for which each is used. These technologies are deployed on our public marketing Website; our partner portal and fulfillment systems do not run third-party advertising or visitor-identification tags.

You may manage these technologies at any time through the link in our Website footer, through your browser settings, or through the provider tools referenced in Section 10. We honor Global Privacy Control (GPC) signals as a valid opt-out where required by law.

1.3. Information from Other Sources

We may receive information from third parties that provide us with information about you from online and offline sources. These third parties may use cookies or similar technologies, including the business visitor-identification services listed in Section 1.2 and publicly available professional information. OK Capsule does not share any of your personal information with third parties other than as described in this Policy.

1.4. Payment Information

When you sign up to become a client or place an order, you provide certain payment information (collectively, "Billing Information") in order to complete your transaction. Billing Information is collected and processed through third-party vendors pursuant to the terms and conditions of their privacy policies and terms of use. OK Capsule does not store full payment card numbers.

2. How We Use the Information

We use the information we collect to process transactions; provide you with the Services; solicit your feedback; provide information about our products, including individualized, premium-grade supplement packets; track fulfillment processes such as logistics, warehousing, packaging, and delivery; inform you about upcoming events, supplements, herbal and nutraceutical remedies, and special promotions; identify prospective business customers and personalize our outreach; analyze use of the Services; improve our Services; maintain security and prevent fraud or abuse; report regulatory events; comply with legal obligations; or otherwise as may be disclosed at the time of collection.

3. How We Share the Information

We may share your information in the following situations:

  • With service providers (custom branded supplements or wellness services, delivery, marketing assistance, IT support, analytics, customer service), bound by contracts limiting their use of the information;
  • With the third-party providers listed in Section 1.2, some of which (advertising and business visitor-identification providers) may constitute a "sale" or "sharing" of personal information under certain state laws, subject to your right to opt out as described in Section 10;
  • With our affiliates and subsidiaries;
  • In the event of a business transaction or sale of all or part of our assets, including a merger, acquisition, or financing, or at bankruptcy, in which case personal information may be transferred as part of that transaction subject to this Policy;
  • In response to a court order, subpoena, warrant, or as otherwise required by law;
  • To other parties with your consent or as disclosed at the time of collection;
  • To protect our rights and the rights of third parties.

We do not sell the personal information of our Partners' end-use customers, and we do not disclose end-customer fulfillment data for advertising purposes.

You may submit a request to opt out of the sale or sharing of your OK Capsule personally identifiable information through the link in our Website footer.

4. Accessing and Modifying Personal Information

If you have registered for the Services, you may access, review, and make changes to your information by following the instructions on the Platform. You may manage marketing communications by clicking "unsubscribe" at the bottom of any OK Capsule marketing email.

5. Data Security

We take commercially reasonable measures to help protect information we collect from loss and unauthorized access, including access controls and encryption in transit. No security system is impenetrable, however, and we cannot guarantee the security of our databases or the safety of information transmitted to and from us over the Internet.

6. Retention of Data

We retain your data for as long as necessary for the purposes described in this Privacy Policy. Retention periods vary according to the type of data and the reason we have or collect it, and certain order, batch, and quality records must be retained for periods required of a cGMP-certified, FDA-registered manufacturer. When information is no longer required, we delete or de-identify it. Deletion requests are honored as described in Sections 7 and 10, subject to legal retention requirements.

7. Your GDPR Rights

This section applies to those who live in the European Economic Area, Switzerland, and the United Kingdom. OK Capsule, located in the United States, is the controller of any data it may collect, process, and hold about you as described in this Policy (other than information we process on behalf of our Partners, for which the Partner is the controller). We process personal information on the following legal bases: performance of a contract, our legitimate interests in operating, securing, improving, and marketing the Services, your consent where required (including for non-essential cookies), and compliance with legal obligations.

You have the right to:

  • Object to the processing of your personal information
  • Request the erasure of your personal information
  • Restrict the processing of your personal information
  • Withdraw consent to the processing of your personal information

You can exercise your rights by emailing privacy@okcapsule.com. You also have the right to lodge a complaint with your national Data Protection Authority. Because we are located in the United States, your information will be transferred to and processed in the United States; where required, we rely on appropriate safeguards such as standard contractual clauses.

8. Children

Our Services and Platform are not directed to, or intended for, individuals under the age of 18 and we do not knowingly collect personal information from individuals under the age of 18. If you are under 18, please do not give us any information. If you believe that we have any such information, please notify us immediately at privacy@okcapsule.com and we will delete the information as quickly as possible.

9. External Websites

The Platform may contain links to third-party websites. OK Capsule has no control over the privacy practices or the content of any of our business partners, advertisers, sponsors, or other websites to which we provide links. As such, we are not responsible for the content or the privacy policies of those third-party websites.

10. Notice to California Residents and Residents of Other US States

If you are a resident of California or another state with a comprehensive privacy law, you may have the right to know the categories and specific pieces of personal information we collect and the categories of third parties to whom it is disclosed; to delete personal information we hold about you; to correct inaccurate personal information; to opt out of the sale or sharing of your personal information, including sharing for cross-context behavioral advertising; to limit the use of sensitive personal information; and to non-discrimination for exercising these rights.

In the preceding 12 months, we have collected the categories of personal information described in Section 1 and have disclosed identifiers and internet activity to the advertising, analytics, and visitor-identification providers listed in Section 1.2. Disclosures to advertising and business visitor-identification providers may constitute a "sale" or "sharing" under California law.

To opt out, use the link in our Website footer or enable Global Privacy Control in your browser. You may also opt out of Google Analytics via Google's browser add-on and manage Google ad personalization at adssettings.google.com. If you are an end-use customer of one of our Partners, please direct your request to that Partner; we will support the Partner in fulfilling your request.

11. Changes to This Privacy Policy

This Privacy Policy is effective as of the date stated above. We may change this Privacy Policy from time to time and will post any changes on the Platform. For material changes, we will provide additional notice where required by law. Please refer back to this Privacy Policy on a regular basis.
